We are currently focusing on litigation funding which is an emerging and potentially profitable alternative asset class (a cross between hedge fund and private equity investment) which contains a number of larger incumbents and now new startups are entering into this space as the notion of litigation funding becomes more well known to various types of claimants. This means more sectors and types of disputes are now available for litigation funders to “invest” into. Litigation funding is well established in Australia, Germany, Canada, US and the UK and is rapidly spreading globally into other countries. Some of the well-established firms are now listed. Third party litigation funding is the process where a third party offers financial support to a claimant of a legal proceeding, mostly in return for a share of the proceeds of the claim, if it is successful. If it is not successful, it is a risk that the third party is willing to take. Parties are generally sophisticated and experienced individuals or corporates and are advised by third party professionals.
Globally disputes are increasing, especially commercial disputes from large corporations to smaller SME’s in the UK where many parties have agreed on UK law as the governing law and this is also why the company is establishing itself in the UK given the number of cases as well as the number of law firms. Funding can cover both legal cases in the courts and also international arbitrations.
